Driver Suspected of DUI Driving in School Crash

|

A driver suspected of DUI crashed into an empty school on November 27, causing various damage to the property, including breaking water pipes. The driver was arrested for suspicion of DUI. The person, whose name was not available, will be facing some serious consequences if convicted. Cases in which a drunk driver causes property damage in an accident, or causes an accident in which others are injured or killed, often faces much heavier penalties than other DUI charges. The fact that government property was damaged makes the case more serious for that driver. Whether he or she was actually over the limit is the question. Even if he or she registered at .08 or above, there are other issues that could allow for the person to avoid conviction.

Any DUI charge is serious; in our state, lawmakers continue to increase penalties for drunk driving, as statistics indicate that DUI drivers are responsible for many serious injury accidents and fatalities. The focus on getting intoxicated drivers off the road has led to many people being charged that were not actually over the limit. Breath testing devices are notorious for getting inaccurate results, and this matter has been proven time and again. A breath testing unit that is faulty, has not been maintained, is not properly calibrated, or law enforcement officers who do not properly administer the tests all can lead to wrong BAC readings. There are many physical problems that can affect readings, including age, weight, and alcohol absorption rates, which go up and down.

If you have been arrested for suspicion of DUI, your first action should be to contact an attorney that is known for achieving positive results. Any DUI defense lawyer that is effective has a high level of knowledge regarding the science behind alcohol absorption, how breath and blood testing results can be inaccurate, lab procedures, testing procedures and all other factors that could assist in the defense.
